Terms of Service

Plain English: buy a license, use the plugin on the agreed number of
sites, don’t resell or sublicense it
. We don’t promise it makes you legally
compliant — no software product can. The legal version is below.

1. Who you’re dealing with

“We”, “us”, “OpenForge” refer to Kazim Sevim trading as OpenForge. “You” means
the individual or entity purchasing or using A11y Suite. “Plugin” means the
A11y Suite WordPress plugin (Free or Pro). “Service” means the marketing site +
license issuance + plugin update delivery.

2. License grant (the Pro tier)

By purchasing a Pro license you receive a non-exclusive, non-transferable,
non-sublicensable right to:

  • Install and use the Pro plugin on up to the number of sites your tier allows
    (Personal 1, Business 5, Agency 25, Enterprise as agreed)
  • Receive Pro plugin updates while your license is active
  • Receive priority support (Business and above) for the term you paid for

What you may NOT do with the Pro tier:

  • Resell or sublicense the plugin or license keys to third parties
  • Use one license across more sites than your tier allows
  • Remove or modify license-validation code (this voids the license)
  • Distribute the Pro plugin in a way that bypasses license validation

The plugin code itself is GPL-2.0+. That license permits modification and
redistribution. This Terms of Service governs what we will support, what
the license key unlocks, and what gets you a refund
— not what you can do
with the source code.

3. Free tier

The Free version is distributed under GPL-2.0+ on WordPress.org. You may install
it on any number of sites without our involvement. We provide no SLA for the Free
tier; community support is via the WordPress.org plugin forum.

4. Billing & renewals

  • Pro licenses are billed annually, in advance, in USD.
  • Subscription products auto-renew. You can cancel anytime in My Account —
    cancellation stops the next renewal but does NOT prorate the current term.
  • Prices may change at renewal time. We give 30 days notice before any price
    change.
  • Taxes (VAT, sales tax) added at checkout where applicable.

5. Refund policy

30-day money-back guarantee. If you’re not happy, email
hello@openforge.org within 30 days of
purchase for a full refund. No paperwork. After 30 days, refunds are
case-by-case at our discretion.

Refunded licenses are deactivated. Plugin drops back to Free tier on your site.

6. What we promise (warranty)

  • We make commercially reasonable effort to keep the marketing site and
    license validation endpoint available.
  • We make commercially reasonable effort to ship security patches within
    7 days of credible disclosure.
  • We make commercially reasonable effort to respond to Pro support within
    1 business day (Business tier) or 4 business hours (Enterprise).

7. What we explicitly do NOT promise

The plugin does not guarantee WCAG conformance, ADA compliance, or
immunity from accessibility lawsuits.
No software product can make
that guarantee — the FTC explicitly fined a competitor for making such
claims. Plugin output is a tool that assists your human accessibility work,
not a replacement for it. A credentialed third-party audit (e.g. WebAIM)
remains the gold standard for legal certification.

We also don’t promise:

  • Bug-free software (we’ll fix bugs you report, prioritized by severity)
  • Compatibility with every theme + plugin combination on the WordPress
    ecosystem (we test against the top 20 themes and most-popular plugins)
  • Uninterrupted service (planned maintenance windows announced ≥48h in
    advance)
  • Recovery of your customer data — that lives in your WordPress database;
    you’re responsible for backups

8. Limitation of liability

To the maximum extent allowed by law, our total liability to you for any claim
arising from the Service or Plugin is limited to the amount you paid us in the
12 months preceding the claim. We are not liable for indirect, incidental,
consequential, or punitive damages — including lost profits, lost data, or
business interruption — even if we knew such damages were possible.

Some jurisdictions don’t allow these limits. Where they don’t, our liability is
limited to the maximum the law permits.

9. Indemnification

You agree to indemnify and hold us harmless from any third-party claim arising
out of your use of the Plugin or Service, your violation of these Terms, or your
violation of any law or third-party right. This includes attorney’s fees.

10. Suspension & termination

We can suspend or terminate your license if:

  • Payment fails and isn’t resolved within 14 days
  • You materially breach these Terms (e.g. share license across more sites
    than your tier allows)
  • You engage in fraud or chargeback abuse

Termination converts you to the Free tier — you keep your data, you keep the
plugin running, but Pro features lock.

11. Privacy

See our Privacy Policy. We comply with GDPR, CCPA,
and applicable U.S. state privacy laws.

12. Governing law

These Terms are governed by the laws of the State of Texas, USA. Disputes will be
resolved in the courts of Harris County, Texas — except that consumers in the
European Union retain the right to bring claims in their local courts as
required by EU law.

13. Changes

Material changes will be emailed to active customers 30 days before taking
effect. Non-material changes (typos, clarifications) are made silently with the
“Last updated” date refreshed. Continued use after a change is in effect
constitutes acceptance.
